Terms & conditions

1. Scope of application & contract language

1. These Terms & Conditions (“T&Cs”) apply to all contracts concluded between you and SCULP WEAR FASHION DESIGNING LLC, a company duly registered and licensed in the United Arab Emirates, with its registered office at: Office 120, Trade Centre 1, Dubai, United Arab Emirates (“SCULP”, “we”, “us”, “our”), via our online store.
2. These Terms apply to all orders placed through our website unless expressly agreed otherwise in writing.
3. The contract language is English. Any translations are provided for convenience only. In the event of any discrepancy, the English version shall prevail.

2. Applicable law & jurisdiction

1. These Terms & Conditions shall be governed by and construed in accordance with the laws of the United Arab Emirates.
2. Any dispute arising out of or in connection with these Terms, your use of the website, or any purchase made through the website shall be subject to the exclusive jurisdiction of the competent courts of Dubai, UAE, unless mandatory consumer protection laws provide otherwise.

3. Formation of contract

1. The presentation of products on our website does not constitute a legally binding offer, but an invitation to place an order.
2. By clicking the “Purchase” or “Place Order” button, you submit a binding offer to purchase the selected products.
3. An order confirmation email acknowledges receipt of your order but does not constitute acceptance.
4. A binding contract is formed only when:
   • your order is expressly accepted by us via email, or
   • the goods are dispatched.

4. Order process & error correction

During the checkout process, you may review and modify your order, delivery details, and payment method at any time before final submission. Input errors can be corrected using the provided edit functions. To cancel the process, simply exit the checkout page before placing your order.

5. Storage of contract information

Order details and these Terms & Conditions will be sent to you by email upon order confirmation. We do not store the full contract text for customer access beyond this.

6. Customer accounts & personal data

1. Orders may be placed as a guest or via a registered customer account.
2. Registration does not create any obligation to purchase.
3. Information on how we collect, process, and store personal data is outlined in our Privacy Policy, available on our website.

7. PRODUCT Details

1. We take care to present all colors, specifications, and dimensions of our products as accurately as possible. However, the way colors appear may vary depending on your screen settings, and we cannot guarantee an exact match between what you see online and the product received.

2. Due to our small-batch production approach, slight variations in color may occur between different product runs. While we aim to match colors within a 75–85% range, these differences are part of our process and reflect the nature of limited, small-scale production.

3. Product dimensions, specifications, and quantities may also be updated from time to time without prior notice.

4. Due to the custom nature of our fabrics, slight variations in feel may occur from drop to drop. We aim to maintain up to 90% consistency in texture and finish, though softness may differ subtly depending on the production process.

   These variations do not affect the overall quality, performance, or durability of the product. Every piece is held to the same standard; refined, considered, and made to last.

8. Prices & payment

1. All prices are listed in AED and include 5% VAT. Delivery fees, (excluding custom duties) will be calculated and shown at checkout before you complete your order.

2. Prices are subject to change. Adjustments may occur at any time due to updates, promotions, or markdowns; temporary or permanent at our discretion.

3. While we take care to ensure accuracy, occasional pricing errors may occur. If this happens, we will resolve it transparently. If the correct price is lower, you will be charged the lower amount. If higher, we will contact you to confirm whether you’d like to proceed or cancel your order.
4. We currently accept the following payment methods: Visa, Mastercard, ApplePay, Google Pay. We also accept Tabby in UAE & KSA.

9. Retention of title

All goods remain the property of SCULP WEAR FASHION DESIGNING LLC, until full payment has been received.

10. Delivery, shipping & customs

1. Shipping fees and estimated delivery times are displayed at checkout and are estimates only.
2. While we aim to dispatch orders promptly, delays may occur during peak periods or due to factors beyond our control.
3. For international orders, customs duties, import taxes, or additional fees may apply. These charges are not included in our prices and must be paid by the customer.
   

11. Cancellations, returns & right to withdrawal

1. Customers may request a return within 14 days of receiving their order, subject to our Returns Policy.
2. Certain items, including socks and underwear, are non-returnable for hygiene reasons.
3. Return fees apply and are non-refundable. Fees will be deducted from refunds or store credit, or a payment link may be issued to settle the fee prior to processing.
4. Refunds, exchanges, or store credit are processed only after inspection of returned items.
5. Exchanges are only available for UAE orders. International returns may be issued as store credit. Full details are available in our Returns & Shipping Policy, which forms part of these Terms.

12. Warranty & defective goods

1. If an item is defective or damaged upon delivery, please contact us immediately.
2. Where applicable under UAE law, you may be entitled to repair, replacement, refund, or price reduction.
3. Normal wear and tear, misuse, or failure to follow care instructions are excluded from warranty coverage.

13. Limitation of liability

1. SCULP LLC shall not be liable for indirect, incidental, or consequential damages, except where liability cannot be excluded under applicable law.
2. Nothing in these Terms limits liability for death, personal injury, or fraud.

14. User-generated content (UGC)

1. By responding affirmatively to a content usage request (e.g. via hashtag or direct approval), you grant SCULP a royalty-free, perpetual, worldwide license to use your content for marketing purposes.
2. You confirm that:
   • you are at least 18 years old,
   • you are the original creator of the content,
   • the content does not infringe third-party rights.
3. No compensation will be provided for the use of approved content.

15. Promotions, giveaways & gift-with-purchase

1. Any promotions, giveaways, or gift-with-purchase offers are subject to separate published terms.
2. SCULP reserves the right to modify or end promotions at any time, subject to applicable law.

16. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
